Learner Support and Welfare Policy

1. Policy Statement

Datalaw is committed to providing a safe, inclusive, and supportive learning environment for all learners. We recognise our responsibility to promote wellbeing, safeguard learners from harm, ensure equal opportunities, and provide appropriate support to help all individuals achieve their full potential.

This policy outlines the systems, responsibilities, and services in place to ensure learners’ academic, personal, and emotional welfare is prioritised.

2. Scope

This policy applies to all learners enrolled on Datalaw programmes (including apprentices, distance-learning learners, and professional development learners); all Datalaw staff, contractors, assessors, tutors, coaches and partner organisations; and all learning environments, including online, workplace, and in-person delivery settings.

3. Relevant UK Legislation and Regulatory Framework

Datalaw adheres to all applicable legislation, including but not limited to:

Safeguarding & Welfare: Children Act 1989 & 2004; Safeguarding Vulnerable Groups Act 2006; Working Together to Safeguard Children (2018); Keeping Children Safe in Education (KCSIE, updated annually) – where relevant to apprentices under 18; Counter-Terrorism and Security Act 2015 (Prevent Duty).

Equality, Inclusion & Disabilities: Equality Act 2010; Special Educational Needs and Disabilities Code of Practice 2015; Human Rights Act 1998.

Data Protection: UK General Data Protection Regulation (UK GDPR); Data Protection Act 2018.

Employment & Apprenticeship Standards: Apprenticeships, Skills, Children and Learning Act 2009; ESFA Funding Rules & Apprenticeship Standards; Health and Safety at Work etc. Act 1974.

4. Objectives

Datalaw aims to ensure learners feel safe, respected, and supported; barriers to learning are identified early and addressed; support is accessible, confidential, and appropriate; staff understand their responsibilities regarding learner welfare and safeguarding; learners receive high-quality information, advice, and guidance (IAG); and reasonable adjustments are provided for learners with disabilities or additional needs.

5. Roles and Responsibilities

Senior Management: oversee policy implementation; ensure sufficient resources and training for support and safeguarding.

Designated Safeguarding Lead (DSL): act as the main point of contact for all safeguarding concerns; ensure compliance with Prevent Duty; maintain secure safeguarding records.

Tutors, Assessors, Coaches & Support Staff: promote a positive, inclusive learning environment; identify learners who may require additional support; make referrals to welfare services or DSL when necessary; maintain confidentiality within safeguarding boundaries.

Learners: report concerns about themselves or others; engage with support services when needed; treat staff and peers with respect and adhere to conduct expectations.

6. Learner Support Services

6.1 Academic Support

  • One-to-one tutor guidance
  • Study skills support
  • Reasonable adjustments for assessments and learning activities in line with the Equality Act 2010

6.2 Welfare & Wellbeing Support

  • Access to pastoral support for personal, emotional, or wellbeing issues
  • Signposting to external mental-health or financial-support services
  • Confidential discussion channels with staff

6.3 Additional Learning Needs (ALN) / SEND Support

Datalaw provides initial assessment to identify additional support needs; individual learning plans (ILPs); assistive technology where appropriate; and reasonable adjustments (e.g., extra time, modified materials, alternative assessment methods).

6.4 Safeguarding & Prevent Support

  • Procedures for reporting concerns about abuse, neglect, radicalisation, bullying, or online safety
  • Safeguarding training for all staff
  • Clear escalation procedures

7. Learner Wellbeing and Safe Learning Environment

7.1 Online and Digital Safety

Datalaw ensures secure learner platforms; guidance on safe online conduct; and procedures for reporting cyberbullying or inappropriate behaviour.

7.2 Health and Safety

  • Risk assessments of learning environments
  • Clear protocols for workplace apprentices
  • Reporting and management of incidents or injuries

8. Confidentiality and Data Protection

  • Learner information will be handled in line with UK GDPR and the Data Protection Act 2018
  • Information is shared only when necessary to protect the learner or comply with safeguarding duties
  • Learners will be informed when information must be shared for safety reasons

9. Complaints and Feedback

Learners may raise concerns regarding welfare, support, or learning provision through Datalaw’s Complaints Policy. All complaints will be logged and acknowledged promptly; investigated objectively; and resolved with fair outcomes and communicated effectively.

10. Monitoring and Review

This policy will be reviewed annually or earlier if legislation changes, regulatory requirements evolve, or internal evaluation indicates the need for updates.
