Resit/Retake Policy for the Level 6 Law and Practice Diploma
1. Purpose
This policy outlines the procedures and criteria for learners who are required to resit or retake assessments for the Level 6 Law and Practice Diploma. The policy ensures fairness, transparency, and clarity in the process, and is designed to support learners in achieving their full academic potential while maintaining the integrity and standards of the course.
2. Scope
This policy applies to all learners enrolled in the Level 6 Law and Practice Diploma. It covers the procedures for resitting or retaking assessments, including exams, coursework, or other forms of evaluation, due to non-passing grades, failure to attend assessments, or other exceptional circumstances.
3. Definitions
- Resit: A resit is an opportunity to retake an individual assessment, usually under the same or similar conditions as the original assessment, to improve the learner’s grade or to meet the required learning outcomes.
- Failed Assessment: An assessment which the learner has not passed, either due to an insufficient grade or failure to meet the necessary learning outcomes as determined by the course’s assessment criteria.
4. Eligibility for Resits/Retakes
Learners may be eligible for a resit or retake under the following circumstances:
- Failed Assessment: Learners who fail an individual assessment (such as an exam or piece of coursework) may be given the opportunity to resit the assessment.
- Extenuating Circumstances: If a learner is unable to complete an assessment due to extenuating circumstances (such as illness, bereavement, or other personal crises), they may be eligible for a resit or retake. In such cases, the learner must have submitted a request for Special Consideration in accordance with the institution’s Special Consideration Policy.
- Non-Attendance: If a learner is unable to attend an assessment (e.g., exam) due to valid reasons, such as illness or personal emergency, they may be allowed to resit the assessment at the next available opportunity.
5. Resit Procedure
- Notification of Resit: Learners will be notified of the opportunity to resit an assessment following the publication of results. This notification will include the specific details of the resit process, including dates, assessment format, and any additional instructions.
- Timing of Resits: Resit opportunities will generally be scheduled at the next available assessment period.
- Resit Fees: If applicable, learners may be required to pay a resit fee, which will be communicated to them at the time of the notification. Fees may cover the administrative costs associated with resit assessments.
- Grade for Resit: The grade awarded for a resit assessment will be at the minimum passing grade (pass/fail) unless otherwise specified by the course regulations. The resit grade will be recorded on the learner’s academic transcript.
6. Retake Procedure
- Eligibility for Retake: If a learner has failed multiple assessments in a module or has not met the learning outcomes required to pass a module, they may be required to retake the entire module, including all assessments. A retake may also be required if the learner has failed to meet necessary requirements to progress in the course.
- Notification of Retake: Learners required to retake a module will be notified promptly, with clear instructions on the retake process. This includes information on re-enrolment, assessment requirements, and any deadlines for submission.
- Retake Fees: Retake fees may apply, particularly if the learner needs to re-enrol in a module or take additional tuition. Learners will be informed of any fees associated with the retake.
- Retake Timetable: Retake opportunities will be scheduled in accordance with the course’s academic calendar, and learners will be provided with specific dates and deadlines for the retake assessments.
- Grade for Retake: The grade awarded for a retake assessment will reflect the learner’s performance in the new assessment. A retake may result in a higher grade than the initial attempt if the learner performs well, but all retake grades will be recorded on the learner’s academic transcript.
7. Conditions for Resits and Retakes
- Maximum Resit Attempts: Learners will generally be allowed a maximum of three attempts to pass an assessment or module. If a learner fails to pass after three attempts, they may be asked to provide evidence of re-learning the content before submitting a request to resit.
- Progression Requirements: Learners must meet the specific progression requirements for the course. If a learner fails to pass key assessments or modules necessary for progression, they may not be permitted to continue to the next stage of the course.
- Support for Learners: Learners who are required to resit or retake assessments will be offered appropriate academic support. This may include access to additional learning resources, tutoring, or guidance from academic staff to help them succeed in their resit or retake.
8. Impact on Final Classification
The results from resit or retake assessments will contribute to the learner’s final classification for the course, subject to the course regulations. In most cases, the resit or retake will count towards the final grade (pass or fail).
9. Appeal Process
If a learner disagrees with the decision regarding a resit or retake (such as being required to retake a module or the grade awarded for a resit), they have the right to appeal the decision. The appeal must be submitted in writing to the Appeals Committee within 10 working days of receiving the decision. The committee will review the appeal and may uphold or modify the decision based on the evidence provided.
10. Monitoring and Review
This policy will be reviewed annually to ensure it is aligned with best practices and regulatory requirements. The review will take into consideration feedback from learners, academic staff, and external examiners to ensure that the policy remains fair, transparent, and supportive of learners’ needs.
11. Publication of Policy
This policy will be published on the Datalaw’s website and included in the course handbook provided to learners at the start of the course. Learners will be informed of the policy and its contents at the beginning of their studies.
